Let me preface by saying that i'm not lawyer.

It does depend whether a clone script is legal.

What you can clone or duplicate is functionality of a website.

For example let's take YouTube. A YouTube clone is meant to act just like YouTube.

That is you can add videos, comment on the videos, create a profile, add friends, etc., etc.

If I created a script that mimiced YouTube I would be fine. No one can hold all rights to functionality.

Where things get illegal is if someone directly copies code from the site so that things look identical to YouTube or use actual YouTube code here and there that is just modified slightly. That is illegal.
