Homeowner arrested for nudity inside home
This topic is generating a lot of discussion in one of the newsgroups I hang out in so I though you guys might like to comment on it also.
A man was arrested for making coffee while nude in his home at 5:30 AM.

Saw this on another forum. If I were him I'd countercharge her for being a peeping tom, and since she involved her daughter... contributing to the delinquency of a minor? Maybe she'd suddenly figure out that filing criminal charges for inadvertent activities isnt a good hobby. What an idiot.

For me there is nothing wrong walking naked in your own house and all alone. I bet he wouldn't do that if there was somebody else in the house.
Poor guy he have to waste his money and time for such a nonsense issue

This was on the news in the UK.
it was his own house and the woman who complained looked into his house.
and why was she with her child at 5:30 in the morning.
He should sue the woman for tresspassing

Unfortunately it is usually the people who mean no harm and are doing nothing wrong that get punished the worst of all for others peoples noseyness! Now if the guy was standing in front of the living room picture window drinking his coffee at the time I would have issue with it.

Wait a minute, folks. The article doesn't mention where the woman was when she seen him. Was she on his property? Was she on the street?
Considering that it was still dark outside at that hour, if the curtains were not closed anyone would be able to see the interior of the home once he turned the lights on. Many homes have a direct pathway from the living room into the kitchen, making it more than possible for someone standing on the sidewalk to see into the kitchen.
This is most likely how the woman seen that he was naked.
There is a term in the legal profession called 'using due diligence'. In this case closing the curtains on the windows would be using due diligence.
But as the man appears to be indifferent about someone else seeing him naked, whether in his own home or not, he did not use due diligence and I can understand how a prosecutor could interpret that as meaning the man wished to be seen and therefore did a deliberate act, which would then make it a crime.

I've read other reports that say she was cutting through his property (trespassing, IMHO) and looked into the window at the back of the house.
How many homes have kitchen windows that are visible from the street? Not many I'd guess.

I have to wonder if that fact plays a HUGE role in why he was arrested. If someone else had filed the report would their actions have been the same. IMHO I kind of doubt it.

Not likely, since she's a cop's wife.
But, yeah, she should be arrested for tresspassing and (as Rob has mentioned) charged with contributing to the delinquency of a minor, since she had her kid with her.

Thanks, Cricket, I didn't realize there was a video there. I thought it was a picture they placed with the article.
My connection is molasses right now and I can't watch the video, but cutting through his yard would place the woman at risk of being considered to be a peeping tom in that case.
I would think she were smart enough to know better than to report him.
But again, where were the curtains? Turning a light on inside when it is dark outside makes everything inside very visible to the outside.
Maybe he didn't think about that.
Perhaps nobody was doing any thinking at the time...
I still think he should've used due diligence.
