New California Law Says Businesses Can’t Stop Consumers From Posting Online Reviews

A new law, just signed this week by California Governor Jerry Brown, makes these contractual waivers, aimed at inhibiting or creating liability for negative online reviews (on sites such as Yelp), illegal.

They can still exist and be enforced in some cases where the wavier was “knowing, voluntary and intelligent.” The retailer or other party seeking to enforce such a contractual clause has the burden of proving those facts.

I see it as a good thing.
A lot of people, myself included, rely on reviews to make an informed decision before purchase.
People need to be allowed to tell the truth in those reviews or the reviews become useless.
This looks like a victory for consumers to me.

I often think the folks in California are crazy with their laws and propositions. This time I fully agree with their actions.

There's a saying about blind squirrels finding acorns that, I firmly believe, came about in honor of our California legislature and Linda Ronstadt's ex-boyfriend, Governor Moonbeam. (Incidentally, script, by and large, outside of the leftist cesspools of SF, LA, and Sacramento, there are actually quite a few sane people here.)
