RackShack
In March, 2003, we got one server from RachShack / EV1Servers. While trying to set up the server with additional IP's issued to us from RackShack / EV1Servers, we encountered problems in the form of bind failure.
After three weeks, RackShack / EV1Servers notified us that they had inadvertently blocked the very IP's they had issued to us. They un-blocked the IP's and we were finally able to use the server. RackShack / EV1Servers stated that they would not issue a refund for the time we were not able to use the servers due to their incompetence.
While using RackShack / EV1Servers, we noted frequent latency issues and hardware failures, even though the server was used for less than 20 sites, none of which were high traffic sites.
Due to these issues, we decided to move to ServerBeach. On June 24th, we moved to ServerBeach and requested that RackShack / EV1Servers cancel our account.
...Three months go by....
While viewing a credit card statement, I see that RackShack / EV1Servers has been billing us the entire time, notwithstanding a cancelled account.
I immediately sent an email to their billing dept, requesting a refund. RackShack replied, refusing to cancel the account, and refusing to issue a refund of the over-billed amount.
I then sent an email to Head Surfer Robert Marsh. He replied personally, stating that he would not issue a refund. He stated a refusal to cancel the account, siting an "established procedure" for cancelling accounts.
I replied that I had followed the established procedure, and the account was still being billed.
He did not reply.
In order to ensure the account was cancelled, I logged into the Member
Services area, and repeated the cancellation procedure.
Since that time, RackShack / EV1Servers has billed my credit card twice, the most recent billing being the 8th of this month.
RackShack / EV1Servers refuses to cancel the account, and continues to refuse to refund the stolen money.

Wow. This is definitely something people should take into consideration before doing business with them. I've seem similar situations posted on their very own forums and the reps come out and end it quickly with a "Send me a PM with your information so I can look into this"....you never hear anymore about it after that.
I sure hope it all gets straightened out for you.

damn, i'd be pissed off as hell, wait, can't you sue them for unapporoved charges? Cause you can say that you closed your account, and they still bill you. (I think thats illegal, though i could be wrong)

Wow, I just read through the WHT thread. It figures they'd want to do this away from the public eye, they wouldn't want anyone to make them look worse than they already are.
Good luck, I hope they choose to do what's right.

It seems over at WHT a RS rep said they wouldn't discuss it anymore in public. Maybe they've found what John was referring to and didn't want to publicly admit it to make themselves look bad.

I just spoke with Mario Rodriguez on the phone. Very kind of him to call me and tell me to f*** off.
These people really need to learn some manners.

Well..as long as you have records of everything, you should definitely expose them for what they are. I knew they were crooked, but man..

He claims he has closed the account.
I just added a link to the EV1 page from every page of this site and a couple other sites.
All in all, that page should be getting seen by about 2,000 everyday after it is indexed by Google.
