About the EV1/ Rackshack link

If you're paying by credit card than you can issue a charge back against the orders in question.

A charge back does not go against yourself, but the company in question (ie, EV1).

So far as I know, charge backs can be issued for a billing history of up to 6 months.

So I would recommend that you contact EV1 about the issue and mention - politely - that if they do not issue a full refund as required then you will run 6 months worth of chargebacks against them for misappropriating your funds.

If they do not respond favourably to that - and give them merely 48 hours to correct the issue - then contact your bank - in person, or by phone - and they will refund your monies to you.

the problem is the terms of service that you agree to when you start a RS account removes those rights from you. Yes he could do a charge back but then he would be open to legal action from rack shack, and it could cost a lot more then what was taken in the first place.
