It seems all 3 .com domains have been registered

Im no pro at this but I rather tend to stay away from a name thats on a .com - you dont know how greedy the .com site could get and try and force you to hand over the .net name.

Wasnt there a legal battle about this a few years back?

If the domain is a trademarked word/name then you could have problems. If it's not, there isn't really anything they can do to take it away from you.

If the .com name is not Trademarked then there shouldn't a problem in registering the .net name. I think .net is the next preferred extension after .com so you should go for .net if .com is not available.

I like .com.

Anytime you use a .net domain, you're bound to be losing traffic to the .com version. We used to run this site (v7n) at internet-marketing-research.net, and people often mistakenly referred to the site as "internet-marketing-research.com".

Thats what they are worth, christ I'd pay 1k or more for the right 3 letter name.
Just think about it, how easy is it to remember 3 characters ?

I just bought a 4 letter domain for $149 ( ezcj.com ).

good short domains are only going to increase in value over time so don't skimp on them if you don't have too.
