Blizzard Wins $88 Million in Private Server Lawsuit

Quote:
How seriously does Blizzard take the operation of private World of Warcraft servers? On August 10th the company was awarded a stunning $88,594,539.00 judgment against a woman who operated a business running her own WoW server and selling items via Paypal. That may seem steep, but over $3 million of that amount came from "inappropriate profits" the woman made from running the server. That's right: her private server, run under the name Scapegaming, was a multimillion dollar business. It also made her a very attractive target for litigation.

Running private servers violates the EULA, DMCA

Creating a private server, and then selling access and items to players on that server, breaks the World of WarCraft End User Licensing Agreement and Terms of Use in many ways.

Wow - that's a chunk of change! But seriously, how could she seriously think they would just roll over and let her continue. As first article says, she did get by with the minimum fine - only $200.00 per occurance.

Wow,,, just wow, I really dont know what to think about that. 88 million dollars? There is no way anyone could ever hope to pay that amount of money back.

What she was doing might have been wrong, but was it worth ruining her financially for the rest of her life wrong?

Wow would be the word :X I think Blizzard should now just invest more on building better servers & offering items with that $88million to offer there gamers. Then maybe there wouldnt of been a reason for her to start offering something that they should of in the beginning.

I agree its wrong, but I dont agree to the amount. Harsh, ouch.

Also 1. If its apart of MMPORG or whatever, & blizzard has the "enviroment" even built to have this capabilities, then why cant you use it? If Blizzard dosnt want people to capitalize & have advantage of playing online off there own network then why do they even have the enviroment?

& 2nd, that article you wrote it says

The amount Blizzard claimed it was owed looking at the Paypal transactions? An additional $20,886,200 in statutory damages.
Does that mean the % that paypal kept as a fee for each transaction? Did blizzard want to try to collect that % fee amount? Great thread.

Great judgement, you cant allow this kind of behavior, no matter if its against blizzard or anyone else. Well done.

3 million in virtual item profits... shouldn't you really stop before you know your gonna get screwed by the law? I wonder how she managed to compensate them with $88 million dollars..

What you seem to overlook is the fact that Blizzard actually IGNORES a huge amount of private WOW servers, some of them actually quite heavily populated. I switched from one of those to the real thing and don't regret it though.
What Blizzard goes for are people who are charging money for these private servers, because that is obviously a copyright infrigement since they are profiting from someone elses intellectual property. People who use to it for fun or for educational purposes are kept be, the maximum I have seen is Blizzard asking to turn the registration of new users off on free private servers.

Blizzard is hardcore, there was once a time however though that they actually cared, but that time has long passed!
