can i take legal action?
Can anyone help?I recently paid for an item from th us using pay pal,it was sent to me but i missed dhl who sent it back where i got it from the seller is now not responding to my emails can and how do i take legal action

First of all, Did you try phoning or faxing the merchant in question? Maybe your emails have gone into their spam bucket. Giving the option to resolve this in a friendly manner might work to your benefit. e.g. Something for free due to the mixup.
If that doesn't work, you can file a dispute with PayPal (check the time limit on this):
Go into your PayPal account.
You should be on the My Account tab.
To the right is Resolution Center.
Mouse over that menu item and there is a link to some tutorials. One of the tutorials is about disputing a purchase.

Not being too nosy here being my first post here and all but how much was it worth? Sometimes trying to go after something or someone with a legal suit can be more of a headache financially and time consuming than worth.

In my opinion regardless what its worth you cannot let people take advantage of you, and seriously if its a an item that was supposed to be shipped to you paypal usually favors the buyer, but be very careful on digital goods and paying through paypal as they usually favor the seller.

Have you tried contacting DHL? It seems from your post that the seller did ship the item to you and the fault wasn't on that end. Considering the cost of shipping, especially to a different country, I'm not surprised that the seller might be reluctant to re-ship (if your e-mails are even getting through in the first place and not ending up in a SPAM filter.)

You should contact DHL and tell them what happened. DHL should re-deliver your item(s).

its a hard issue if you do not have contact with the merchant. I being a merchant know that we are here for the customers 5 days a week 8-6pm.
copenhagan said it best. lawsuits are expensive. and silly if you ask me.
If it is a shipping problem. you may have to pay a reshipping fee because shipping ain't free... when a merchant sells an item it still costs them money to ship. and to receive it back is just as bad if not worse.
Have it sent somewhere where you know there will be a person during normal business hours. or wait for DHL when they give you a tracking number. Or leave a note for the UPS guy.
If you still have problems with getting your money back and you've exhausted your means of communication dispute the charges... but do not do this lightly... last resort only. it costs $20 for the merchant. and he may choose to take it out of your refund when the CC company decides to reverse it in the merchants favor. (I used to work for the the largest CC company out there i know)

You can take action but not sure that you will be get success.
Because this type of work have no grantee. If you have any solid mail from the opposite side.

I was wondering how this went. Were you able to resolved the issue? These kinds of situations are a stinker and can be a pain but usually there is a resolution at some point. Please inform us so we all know for the future

You can ask pay pal to pay you back they will take time to process it and they will give you your money back!! But first ask DHL that what kind of services they are providing. Tell your name and sellers info what ever you have. Or tell them your address they will track it surely!!

if you used paypal , you should warn them you didn't receive the item
they usually end the dispute by refounding the buyer

I have never been in this situation before. But if I was I think I would:
1) Try and contact DHL, and give them a lesson. Mayby see if they can ship it over again?
2) If DHL has allready given the package back to the seller, I would contact him.
3) If neither 1 or 2 works, I would go to Paypal and file for a dispute. Useing the option "The goods was never recieved".
4) If 1, 2 or 3 doesnt work I would go to my local police station. I would print out every email sent between me and the seller. I would print out everything from Paypal....

You could provide the DHL address again, and ask the seller sent the goods again. If the seller is still not responding, you could accuse him of cheat。

probably......but seller has the copy of the first receipt that he losts.
I suppose that he can open a dispute on paypal and probably he will get his money back.

They don't usually send the good back. They are supposed to reach you thrice and even call on the number provided, or you can pick it up from their office.
If for some reason it's been shipped back, then you shouldn't be paying for it. Call the shipper, give them your tracking number, ask them for a final update. If you don't like what you hear, file a dispute. PayPal will freeze the concerned funds and DHL will be forced to take some action.

start a dispute on paypal in paypal, Paypal will favor always to buyer in case of physical goods. Please start dispute as early as possible. b/c buyer protection is limited to some time period, after that paypal will not help.
