Yup... Lawyers are the bane of our existence in this country. Best thing to do is find a fresh shingle that likes what you are about and buddy up with them. Really it is the paralegals that do all the work anyway. Lawyers don't like courtrooms that much, they usually take only slam-dunk opposition.

Ok big daddy. I've been properly schooled. However I don't agree with you. But who cares? Not me. You go on believing what you want. They will steal all they want for as long as they want and there isn't a damn thing you can do about it. And it will continue until 2012 and then it won't matter because there won't be an Internet. God I love BS sessions! Viva' Nostradamus! lol.. You're funny.

"Fair Use" doctrine allows limited copying of copyrighted works for educational and research purposes.
The copyright law provides that reproduction "for purposes such as criticism, news reporting, teaching (including multiple copies for classroom use), scholarship, or research" is not an infringement of copyright.
This is a defense to infringement and is limited in scope. If a use qualifies as fair use is decided by the courts, which balance various factors, and is decided on a case by case basis: Think GUIDELINES, not RULES.
the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes
-the nature of the copyrighted work; factual or more artistic
-the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
-the effect of the use upon the potential market for or value of the copyrighted work.

What is clear, is that it is a grey area.
The courts will decide... Most likely the content of your blog refers to newsworthy or educational
publications - but if your service provider doesn't want to spend time and money to find
the truth - may be it would be safer to know for sure you are using images legally,
and there is no infringement of copyright.
There are many sources of free images and not expensive images for blogs.

Downloading is not violation but using that picture for public use is copyright violation.

Ummmm... you realize that the term royalty free does not mean the image is FREE for you to use right?

Royalty Free does not mean a user is free to take and use whatever content they find available to them. It only refers to a specific licensing contract between two entities. The licensor, usually the content creator, always retains all copyright to the content, including the ability to distribute it, or allow redistribution. Each licensing contract is different. Some may allow reselling of items that include that content, such as a t-shirt or calendar with an image, and others do not. The terms of the license should be researched, to be assured if the license includes the rights desired by the license. http://en.wikipedia.org/wiki/Royalty-free

I think its illegal because of copyright issues. However, there are sites that have royalty free which you can copy, download and use that certain images to post it in your site.

Is downloading a picture from a site violation
|
I think it's a violation if it's copyrighted but if it's not, then you can use it. To be safe, try to provide with your own picture for your site.

The general rule of thumb is that if you didn't create it, seek approval before you use it. Everyone (and I mean everyone) has a different idea of what constitutes copyright infringement and even though it can cost an arm and a leg to prove it, I'm sure there are plenty out there who surf the net with both arms and legs (stupid phrase but you get the idea).
Always check to see if there's any copyright nomenclature at the source and if in doubt, contact the site owner/webmaster/etc. If you don't hear back from them then just don't use it at all and look elsewhere.

everything is copyrighted on the internet if you rip someones picture and put it else where on your site or modify it they can file a legal complaint against you, but I doubt someone really cares that much.

I know quite a few photographer that care enough to have the site shut down if necessary.

Most hosting companies take copyright infringement very serious and in fact include it in their terms of service.

You agree that in the event that 1&1 is informed by any party that your domain name or any material on Your Web Site infringes the copyright of any party, or violates the right of publicity or privacy of any party, or consists of any other claim or violation of intellectual property rights of any kind, then 1&1 may, without prior notice to you and in 1&1's sole and exclusive discretion, either remove the material from Your Web Site, and/or disable public access to your domain name or the material on Your Web Site, and/or terminate this Agreement, without any liability of any kind to 1&1 from either you or any third party. As more completely set forth in Sections 5, 6 and 9, you waive any and all claims you may have, now and forever, against 1&1 relating to any action taken in response to the claim that you have infringed the intellectual property rights of a third party, and agree to indemnify and hold harmless 1&1 from and against any such claims. http://order.1and1.com/xml/order/Gtc...linkOrigin=Gtc

I think its not a copyright unless there is a watermark on the image of the original owner.
