Is it against the law to use someone else's photo on your profile?

. . . like you're trying to impersonate that person.

I've seen this happen on forums before and I'm wondering if its against the law.
Its probably hard to sue over this, since most things that happen online are not easy to prove in court.

There is no Law that applies everywhere in the world.

Furthermore, such use does not necessarily mean that you are impersonating them.

it would be nothing as long as you are not using them for commercial use or slander, but the owner of the picture still reserve the right to ask people to retrive the picture

It's really not that simple. It all depends on the Laws of the jurisdictions involved.

hi,
this will not be against law if you are using any celebrity photo. but if you are creating a fake account and using other's photo in your profile then it might hurts that person reputation. which is not legal.

May or may not be the case, depending on the Laws of the jurisdictio(s) involved.

Likewise as above.

Can I also add this: The laws can also be complicated and it can cause major problems if you are not careful!

Has that not already been more than amply emphasized?

Firstly, the question is not if it should be, but if it is.

Secondly, just because something can be used in an improper manner by someone does not mean that all uses of that thing by all persons are necessarily improper.

I'm going to break it down like this. And really, I only know US law.

Is it illegal? Probably not unless you are using it for fraud purposes. Illegal refers to criminal.

Can you be sued for it? Probably and probably you would lose. But that is an expensive lawsuit and people will probably not spend the money to do it.

Just use your own picture or one you buy the rights to and you don't have to worry about it though. You can get pics from stockphoto places for $1 and it could save a lot of headaches if you have a reason not to use your own.

What leads you to that conclusion?

I'm not going to get into a long debate on the fine points of copyright law. Bottom line is that how this normally happens is someone finds a picture somewhere and uses it. The vast majority of those pictures are copyright protected. (again, I'm speaking of US which is the law I know)

If you own the copyright or it is public domain, then the picture might fall outside of "probably".

As posed, the OP's question does not necessarily entail such infringement.

Hence my questioning the conclusion with regards to probability.
