Copyright Question

I have contracted to have a company design a new website for me.
I have given them examples of features on sites that I like, and a few pages have been "designed"
While it is my content, the formatting... components (tables, picture placement, font type) is really similar to another site that had been in my (sites I love) examples..

Is website format copyrighted - or just website content ?
I guess I am able to tell this designer Yah or Nay.. but I do like the way the site is looking, even tho it is remarkably similar to the other site.

The work is progressing and if he uses the format - it is legal to do so ?? Although the designer is in India, so maybe he is not subject to rules in the US .. ??

Would like some direction.
Would hate to get the site designed and have someone thinking that they were copied. Although the site is similar not exact..all content is being added by me.

Under copyright law, there is a concept known as copying "the look and feel" of another's work.

While the other company can complain, "look and feel" is like pornography, the courts cannot define it, but they know it when they see it.

It depends on how they did the formatting. If they grabbed any of the code from that site, that would be a big no-no. Otherwise, from a copyright status it would be hard to say.

You may also need to worry about trademark. If you are both in the same market, copy a competitor in a manner that would cause confusion can land you in trouble. As it is possible some of the graphics are trademarks.

You would have to provide code of both websites to see if it is actually copied.

There's nothing wrong with getting inspiration from other websites, as long as you combine the inspiration with your own imagination to create something 'new'.

Copyright problem is inevitable on internet. I see some issues about this today, both of them don't have an effective way to solve it, as most of people are greedy and idle.

Using the same layout of others website is subjected to claim in copyright law! How about the functionality that your are using for your website? Does it follows the same functionality as the site you are talking about?
