CAL. PEN. CODE § 502
CAL. PEN. CODE § 502 or the "COMPREHENSIVE COMPUTER DATA ACCESS AND FRAUD ACT"
(1) Knowingly accesses and without permission alters, damages,
deletes, destroys, or otherwise uses any data, computer, computer
system, or computer network in order to either (A) devise or execute
any scheme or artifice to defraud, deceive, or extort, or (B)
wrongfully control or obtain money, property, or data.
Thought I would put out the facts first.
My now ex girlfriend I was living with, I came home and she was pissed about an arguement we had about money. She demanded my keys that went to her cars and to the other house she owned. I asked where my laptop was and she said she pawned it?
I left before I blew a gasket and moved out a couple days later ending the relationship.
She sent me a text stating I can have my files off the laptop when she got them out of hawk, this women could have used a credit card.
I never got my files or the laptop back. She told the police that she never gave me the laptop, that it was hers and the police told me I had no case. I'm sueing her in small claims next week for $10k
Looking at the code above, it looks like to me, even if I don't prove that the laptop is mine, which I had been using it for 5 months and she bought two laptops when she purchased this one, that my data is protected. She admitted to having it as well.
What are your thoughts on this?
