Legal issues about Porno sites

I am a resident of Japan. I have recently got an offer to make a porno website for Japanese girls in English. This propsed site will sell services such as X-rated pictures and movies which can be downloaded by the members.

However, before accepting this offer, I'd like to make sure about the various rules and regulations regarding international porno sites.

Also I'd like to know reliable payment processors which accept credit card payments from such adult websites.

Japan isn't a great place to host a site like that. As I'm sure you know, here in Japan the laws don't look favorably on porn which shows the genitals. (That's why JP porn has the good area blurred.)

In America, there are strict record keeping requirements. (18 U.S.C.Section 2257)

Better to host porn sites from some other country, IMO.

Thanks John. Yes, you are right. The proposed site is not meant for Japanese. It is meant for English speaking countries and of course Americans would be potential customers too. And my client is Japanese who has access to all the stuff without the mosaic.

So if we host the site in a country other than USA - say a country in Europe - are we exempted from the strict record keeping requierments - even if our customers may be Americans or domain is registered through American company like GoDaddy?

I'd talk to a proper lawyer who understands international law and online concerns.

This is too big an issue to get a firm answer from a forum. If you had to stand up in court and say "your honour, v7n admins and members said it would be OK" you'd feel very silly.

You are producing the material in Japan, the profits return to Japan, the staff are in Japan - as are the "models". Just basing the server offshore shouldn't be enough to stop you needing to comply with local laws.

There was a blog about by a novice male porn star which lasted only a few weeks - someone told his Mum or something. He was a law grad living in Boston. She must have been so proud!

Moneybookers seems to be happy to take money for porn. (And gambling, case you need to know some day which payment processor supports the vices.) (Hmmmm; never saw them as a choice on Rx sites. They need to conquer those next!) But as sarahk says, because of the enormous legal ramifications, you'd do best to get yourself some legal advice. You'll prolly wanna do all of thise in a country which doesn't give a crap about anything, like Belize, although I've always wondered what happens if the bank there funks with you? Who're you gonna complain to, the police? And what're they gonna do when you say the bank's hanging onto your gambling or porn money?
