If you read the entire thread you will find that there are many members of the opinion that the sites have nothing in common beyond the product itself.

if you find a niche herbal product and you put here for sale, then i approach you and show the interest to buy the site and take all info and then i start a new site same like yours with same products just differnt design and differnt content..
what would you do in that case ? any thoughts

You seem to be implying that his site is of a different design and content. Which means you are left with arguing that he is selling the same product as you.

Do you have exclusive rights to this product?
Do you manufacture this product, if not does the manufacturer distribute this product via other retailers?
Are there other sites on the internet selling this product as well?

Could you answer these question, please.

Do you think he has broken any laws? Only you can answer this?

If you conclude that he has broken a law then you can pursue him legally. Also if he were to sue you for libel you could at least make a case in your own defence.

If he has not broken any laws, then all you can do is chalk it down to learning how to do business more effectively. What information did you provide him that he could not find else where? If you provided him with this information why did you not ensure you got paid in advance? Did you have a contract with him that you would disclose information at some cost to him?

By making unsubstantiated allegations of this nature you stand the chance of ruining your own reputation and not just his. If you have been wronged in this way, I sympathise greatly with you, but you really must provide more, you cannot just assert that he has done you wrong.

You cannot expect me to condemn someone else on your word alone. I have not even heard his side of the story. You have only given us the address of his site and by your own accounts his site does not look like yours and does not have the same content.

Please think carefully and justify your claim, what law has he broken?

If all you have is a grievance based on moral grounds that he should not have a site selling the same drugs as you do, then in my opinion you do not have a case at all.

So just to clarify, according to your own posts in this thread, started by you:-

his site does not look the same as yours,
his site content is different to yours,
and he has not broken any laws.

And from the quote above I might conclude that the only reason you started this thread was so you could bad mouth him.

I'm afraid you have learnt a valuable lesson about doing business the hard way. While I can sympathise with that, I cannot condone your intent in starting and continuing this thread.

To prevent situations like this occurring, in future ensure that before any sensitive information is passed on, that both parties sign up to a contract stating their rights and obligations, including when payment is to be made and how. Never give out sensitive information before you have been paid.

IMO, it would be best to get back at this person the proper way and through legal means. A good option is to inform the Host of the site about the copied content. But if only the concept was copied and he is selling those same products legitimately, I honestly don't think there would be any issue here. Unless you have proof that you were selling him the IDEA and that he actively engaged in conversations with you, but then later decided to just bypass you and utilized your IDEA without your consent.
