I think if you copy all the whole script its illegal but maybe if you only copy the functionality it could be legal.

Best to try asking about the lawyers.

Some are, some aren't. A Facebook clone, for example, is illegal. If the website has patents on their scripts and website skeleton (Like Facebook does), then a clone of it is not legal to own.

for me clone scripts are legal, many sites use it and they dont get cautioned for it in any way.

My mom always says, "Copying is the sincerest form of flattery..." but sometimes it feels like invasion! lol

I read the article htmlbasictutor posted (thanks html!) and think the whole article is spot-on but this sums it up quite well as far as thinking cloning will somehow make you more popular:
