From the moment of conception, it has human DNA. It is a living organism with its own DNA which is seperate from that of its mother. From the time of conception until it reaches maturity at 18 years or so, the organism will go through many stages of development, but through every stage it remains a human organism. The courts do believe that unborn children are human, they just give the mother the right to take that life until the baby reaches the point that it is able to survive outside of the womb.
