Which fonts wouldn't be penalized by se's? Very large, and very small ones would be penalized.

IMO, Tiny text (font size smaller than normal size) are used sometimes to try and stuff keywords into a page... these is spam ... SEs may penalise or ban sites using this technique....
keep font at size 10 or higher ...

My philosophy is that font, especially size, is generally the user's perogotive, not the web author's. There are special cases when overriding the user's settings make sense, but in general use the defaults set up by the user.

If you do change size, do it in a relative manner based on the user's dafault. The user might well need a large font, either due to poor vision or a large screen (2048x1768 say). A web author who forces a font size, even 10, may well make his site unsusable.

Mozilla/Firefox partially solve this problem by allowing the user to resize text on every page. IE allows font sizes to be locked-in, and won't allow the user to change it.

Generally 10-12 pt is a good size. If you specify Verdana, it will be somewhat bigger and cleaner than many other fonts.

Too small fonts can be bad for the SE, but it can be harder for people with less than perfect vision. If you must use small fonts, be sure you allow additional whitespace. If you want an over 40 crowd to be part of your target, keep them in mind with your font size.
