Flash Penalties SEO Question
Hey what if the header of a webpage is in flash, but the navigation is in HTML. Would the website be penalized for having a flash header?

Nope
There is absolutely no problem for such a thing. I did that on my Sorcier glouton contest page, and it worked perfectly

Search engines do not penalize a site using Flash, they just (most of the time) have hard time to index it. But if the navigation is in HTML, everything's fine.

Rolls Royce uses flash in it's header and many other sites do and I've never seen any negative effect in rankings and certainly not penalties.
