duplicate content???? someone help with this one

Ok guys say i have a page with this url
http://www.lawfullywedded.com/weddin...alifornia.html

and its already cached in google, but i decide to make the page deeper by putting it here
http://www.lawfullywedded.com/weddin...alifornia.html

But since the first url is already cached will the second url be considered duplicate content or since the first url is now 404 will it cache the new page and use that in the serps?

Oh and if someone can tell me why my flag isnt appearing at the top of the page for the states like it does at the homepage http://lawfullywedded.com i would appreciate it.

here is the answer to the second question:
"lawfullywedded.com/wedding-locations/images/gay-glory2.jpg"
is what you have right now...

the correct address is:
"lawfullywedded.com/images/gay-glory2.jpg"

the "wedding-locations" is causing the problem

thanks i got hold of aaron and asked him, he gave me hell but said it should be fine......and i got the flag working again.........thank you for your help guys

Awalli,
one thing to mention is that instead of making the previous page a 404, make it do a 301 redirect to the new page. That way your content won't be considered duplicate.
