Is my seo Hat Black or White?

Hi everyone,

I just finished a classifieds website, 100% of the pages have the same navigation menu on the left side.

I tought that to avoid duplicated content on my website, i'll replace the html (without script) navigation menu with an external javascript generated menu.

Is that black hat or white hat seo?

I read somewhere that Google is wary of external js which is blocks spiders via robots.txt.

And Google does index some js.

This is how the file works:
- if called from the website: displays the navigation menu
- else : produces a blank page

I'm not sure what to do!
-Should I block this javascript file from being indexed with a robots.txt file
-and/or generate a 404 error ??
-or simply add the same non javascript navigation menu on all my page (like many and many websites do!)

Any hints are welcome

Honestly, I`ve never had such issues with javascript menus ( yours is probably dhtml ). Your javascript might get indexed, like scott pointed out. You could add a disallow in the robots.txt file for the javascript.
