You need to remove the background from the image you want to use. Then make sure your saving it with transparency enabled.

When you open photoshop and open a new file you can choose the background colour, make sure this is set to transparent. If you are working with an exisiting photo you will need to create a path around the object and either invert to remove the background (by pressing delete) or paste into a new file with transparent background.

If your first layer is the background color and is locked, just create a new layer and double click on the first layer to unlock it and then delete it.
