Exclamation Being suspended without refund from a hosting company

Because i have used too much cpu and memory in their "Unlimited, boosted Hosting plan" which i paid $380 until June 2013, they permanently suspended my account and they refuse to pay my money back. Not even the rest of my money which i havent had the service for yet.

What can i do?
Please suggest me!

Sorry for your experience. Now learn your lesson and move on. There is no such thing as unlimited and next time read the TOS a bit more carefully. No refunds when violations occur is a pretty common clause.

Yep, they probably have you over a barrel here. Always read the Terms Of Service at any webhost, but especially "Unlimited" webhosts, there will always be clauses on CPU/Disk usage etc.

Think of it logically, a webhost pays $xxx for a dedicated server, they then sell you an unlimited hosting account for $xx and then you go ahead and use all of the resources available, there loosing money hosting your account. Unlimited webhosts thrive on people not using anywhere near what they pay for.

TOS are a great way for unlimited hosters to get out of such mess. So don't forget to read the TOS whenever you pay for services online.

We were using shared hosting years ago. Every time that they were telling us you will get unlimited everything, we would have asked them why Google.com is not using your plan so that they can save billions of dollars. Then, they would have referred us to their TOS link.

Haha. I like this one.

So since almost nobody reads TOS or PP i shold just open up a company and put whatever i want in my TOS then sell a hosting and then say hey you abused it, and kick them out after a month once they paid me for 1-2 years. That sounds like a good deal huh?
You can make one year of income in a month.

Isnt there a place to check/control/punish these kind of people and companies? Isnt there like a BBB or a complaint department? Cant you just now do anything when they rip you off?

A while ago an online store put in its TOS a voucher so that if someone actually read the TOS they would notice they could get 20% off or something along them lines. Later on they released it and out of the thousands of orders they had had that week. Only about 2 people got the discount.

I'd recommend trying to solve it with them first. The last resort option would be to go to your credit company and try and get a chargeback dispute going.
