Can I sue my domain/webhost provider?

Dear Guys,

I made two accounts with a webhosting provider called Net4.in

Now, I bought a domain and hosting - for each of these two accounts.

However, I have pointed the domain of one account to another server/webhost....and I now want that domain of the other account should be able to use the hosting of the first account.

However, Net4.in tells me that this service is not available with them. But this is something I urgently need to get done.

Can I sue them for not being able to provide such a service...even when this is not written anywhere on their website?

lol, no, you can't sue a company for not doing what you think they should be doing for you. If they said that they could and then after you started hosting with them they said they can't, then you would have a case. In this situation, I don't think you can... sorry about that.

Which reason they gave you? Maybe its as part of the agreement.

Sure!

Here in the US you can sue anyone anytime for anything.

The fact that you would ask such as question tells me you have never been a party on either side of a suit.

You can spend some time researching the process or you can take my advice and move on.

Yup...never been a party to this alright!!

Well, I don't know what to do. I've bough hosting from them till 2011 and the corresponding domain is already pointed to elsewhere...since the features I have on my website are not supported by the hosting I bought from this company.

Also...with the domain name pointing elsewhere...I cannot even access the files that were uploaded to this hosting. And there was no agreement of any sorts..I just bought it online...and their site does not seem to have any terms and conditions.

I think that it is enough to ask them for refund. That is only one way for you now. Next time I'm sure you will be more accurate in choosing web host.

if your host has promised you for that earlier than yes you can sue him.
and if he has not given anything in written then you should not.

consumer forum. in layman language consumer court.


process
you have to go to that city your host is operating, where you paid cheque or communicated.

b4 that you have to write few registered letters requesting them for refund or providing services.

and in final letter you can mention consumer court thing.

then write one application for the same covering every evidence in annexure make 5 copys of it to submit and a payorder of Rs100.

go that district court and submit it
they wil then give you a date on that date you have to visit court and appear in front of judge (formally known as president of consumer forum)
and tell your case then its upto him to accept your case if he accept your case.

and if he does then he will direct you to send one registered letter with court order to the respondent that is your host.

and now you have another date when reposndent will reply and so the proceeding continue..

now you only want to redirect your other domain to first domain isn't it

you might have been given domain control panel from there you may redirect your domain.

wont be difficult.




pls I am no legal guy not a lawyer so dont take my advice as professional advice.
if you want you may visit these courts and see the proceeding over there and you might find some lawyer over there who can help you.


my suggestion:
you should confirm everything in advance and in written
and going to court or fighting should be avoided in everyway
focus on your work rather taming or giving lesson to someone(your host)

I would just see it as a lesson learned. Unfortunately, you paid way to far into the future. That is why it is always best to go with a one-year term, at the longest. Just see if they will give you control of your domain, and then move to a new host. You will have lost some money, but at least then you'll be able to operate your site in the manner you wish.

Hosting until 2011??!!! Are you nuts? You should have bought a month or two instead of doing this.... now you would constantly experience problems if host is unavailiable to do some things...

Is that possible to charge back? IF yes, immediately migrate!

Se no reason start worry about. I believe once thigs are going bad he will be able to return money with no problem anywhen he wants

Could you sue them? Yes. Will you win? Probably not. Will it cost you a lot of money to get a lawyer? OH YES. So if you are willing to spend atleast $3.000 on lawyer fees....

You are wasting your time.

1) Ask for a final clarification about the status of your hosting account
2) Resolve to solve the problem amicably. Call the PERSON IN CHARGE and ask him/her about the situation. Most staff are lazy to help you go through the process, however, the owner of the company are very concern abt the credibility of his/her company and hence they are more likely to help you solve the problem
